This policy outlines the rights and responsibilities associated with owning Cashew Gets a Job NFTs, ensuring that all holders understand their benefits and obligations.
1. DEFINITIONS
“ART” refers to any digital creation, design, or illustration produced by its author and first released to the public by the creator, which may be associated with an NFT and can be transferred or licensed to an owner (subject to the limitations set forth herein).
"NFT" means any non-fungible token, often referred to as digital collectibles, issued and tradable on a blockchain.
“CREATOR” signifies the entity that released the purchased NFT and its associated art to the public on behalf of its author, or that acquired those rights and interests, e.g., SFR, LLC.
“OWNER” indicates the current owner of the NFT. In the case of ownership transfer, including resale, the recipient becomes the sole owner of the purchased NFT. While there may be multiple owners of each NFT over time, only one owner holds rights at any given moment. Owner encompasses both the primary owner and all subsequent owners.
“OWN” refers to possessing an NFT that one has purchased or otherwise rightfully acquired from a legitimate source, with proof of such acquisition recorded on the relevant blockchain.
“PRIMARY OWNER” denotes the individual or entity recognized as the owner on the effective date and a party to the primary assignment.
“PURCHASED NFT” describes an NFT that one has purchased or acquired in any way, thereby establishing ownership.
“RESALE” signifies the sale by the owner of the purchased NFT, along with rights to the art, to a subsequent buyer, who will then own the purchased NFT and rights to the art (to the extent such rights are transferable upon sale) once effectively purchased.
2. Purpose
This ownership assignment agreement governs the terms and conditions of the assignment of rights, title, and interest in the intellectual property rights on the art to which this agreement is attached (the “Agreement”). It applies to the primary assignment under which the creator assigns to the primary owner certain intellectual property rights on the art and all secondary assignments between the owner and subsequent buyers of the purchased NFT, where applicable.
By acquiring the purchased NFT and related art in any way, the owner acknowledges having read this Agreement and agrees to abide by its terms and conditions. This Agreement shall remain in force as long as it is attached to the purchased NFT.
3. Ownership Rights
When you purchase a Cashew Gets a Job NFT, you obtain ownership of that specific digital token. This ownership grants you the following rights:
- The right to display your NFT in your personal collection or on social media platforms.
- The right to sell, transfer, or trade your NFT on supported marketplaces.
- The right to create derivative works based on your NFT for personal use only.
4. Licensing Agreement
By owning a Cashew Gets a Job NFT, you receive a limited, non-exclusive, and revocable license to use, copy, and display the artwork associated with your NFT. This license permits you to:
- Use the artwork in online and offline marketing, promotional material, or personal projects.
- Create derivative works for personal use, including but not limited to merchandise, fan art, or digital displays.
Please note that this license does not grant you any ownership rights to the underlying artwork or intellectual property beyond what is expressly stated here.
5. Transfer and Resale
Owners of Cashew Gets a Job NFTs are entitled to transfer or resell their NFTs at any time. A royalty of 5% will be applied to each secondary sale of a Cashew Gets a Job NFT. This royalty is automatically deducted from the sale price and distributed to the original creators to support ongoing community and project development.
All transactions should be conducted through reputable marketplaces that support NFT trading. Cashew Gets a Job is not responsible for any disputes arising from transactions conducted outside of these platforms.
6. Community Guidelines
As a member of the Cashew Gets a Job community, we encourage respectful engagement. Owners are expected to adhere to the following guidelines:
- Promote a positive and inclusive environment for all community members.
- Do not engage in harassment, discrimination, or illegal activities.
- Respect the rights of other NFT holders and their artwork.
7. Limitation of Liability
The Cashew Gets a Job team is not liable for any damages or losses resulting from the ownership or use of Cashew Gets a Job NFTs. This includes but is not limited to losses from resale, market fluctuations, or technical issues with blockchain networks.
8. Modifications to the Policy
Cashew Gets a Job reserves the right to modify this policy at any time. All updates will be communicated to the community through official channels, and continued ownership of a Cashew Gets a Job NFT after any modifications will signify acceptance of the updated terms.
9. Sharing Your Cashew & Promoting Your Cashew Projects
As a company, we thrive when our community thrives. We want to know about you and Cashew! Please send us any pictures, art, screenshots, etc., of you and your friends and family with Cashew. If you are open to us resharing them, submit them here.
If you are getting started on a project intending to make commercial use of your Cashew NFT and related art, please let us know by describing your project. This will ensure your project complies with this Agreement.
10. Assignment & Limited License to Use
Personal Use
In consideration of the purchase price and subject to the primary owner’s compliance with the terms of this Agreement and applicable laws, the creator grants a limited, worldwide, nonexclusive license to the primary owner to copy, access, and use their Cashew NFT and related art for personal, non-commercial use, provided that the primary owner keeps all copyright and other proprietary notices intact.
Commercial Use
The primary owner is granted a limited, worldwide, nonexclusive license to use their Cashew NFT and related art for commercial purposes.
